Terms of Use
Effective 15 October 2026 · Last updated 16 October 2026
Pregtionary explains pregnancy words. It does not replace your midwife or doctor.
- Always check health questions with a qualified healthcare provider.
- In an emergency, call your local emergency number or go to the nearest hospital.
- Pregtionary Pro renews automatically until you cancel it in your App Store or Google Play settings.
- Your journal belongs to you.
1. Agreement
These Terms of Use ("Terms") are an agreement between you and Pregtionary, South Africa ("Pregtionary", "we", "us"). They apply to the Pregtionary mobile app, Pregtionary Pro, the in-app shop and preg-tionary.com (together, the "Service").
By downloading or using the Service you accept these Terms and our Privacy Policy. If you don't agree, please don't use the Service.
2. Not medical advice
Pregtionary provides general educational information only. It is not medical advice, diagnosis or treatment, and it does not create a doctor–patient or midwife–patient relationship.
- Every pregnancy is different. Week-by-week sizes, timings and milestones are typical ranges, not predictions for your pregnancy.
- Always ask your doctor, midwife or another qualified healthcare provider about your health or your baby's health, and never ignore or delay professional advice because of something you read in Pregtionary.
- Pregtionary cannot detect or monitor medical conditions. If you notice bleeding, severe pain, reduced baby movements, signs of labour before 37 weeks, or anything else that worries you, contact your healthcare provider straight away.
- In an emergency, call your local emergency number (in South Africa, 112 from a mobile phone or 10177 for an ambulance) or go to the nearest hospital.
3. Who can use Pregtionary
You must be at least 18 years old, or the age of majority where you live, to use the Service and to make purchases. By using the Service you confirm that you meet this requirement.
Your account
If you create an account, keep your password private and tell us straight away if you think someone else has used it. You're responsible for activity on your account, and the details you give us must be accurate.
4. Your licence
We give you a personal, non-exclusive, non-transferable, revocable licence to install and use the Pregtionary app on devices you own or control, for your own non-commercial use, in line with these Terms and the rules of the app store you downloaded it from.
You may not:
- copy, modify, sell, rent, sublicense or distribute the app or its content;
- reverse engineer, decompile or try to extract the app's source code, except where the law specifically allows it;
- remove or change any copyright, trademark or other notices.
5. Pregtionary Pro
Pregtionary Pro is an optional paid upgrade that removes ads and may unlock additional features. The features, price and billing period are shown in the app before you buy.
- Billing. Pro is sold through the Apple App Store or Google Play and charged to your store account when you confirm the purchase. Prices include any taxes the store applies.
- Automatic renewal. Subscriptions renew automatically at the end of each billing period at the then-current price, unless you cancel at least 24 hours before the period ends. Your store account is charged for renewal within 24 hours before the end of the current period.
- Free trials. If a free trial is offered, it converts to a paid subscription when it ends unless you cancel before then. Any unused part of a trial is forfeited when you buy a subscription.
- Cancelling. Manage or cancel in your device's App Store or Google Play subscription settings. Deleting the app does not cancel your subscription. After cancelling, Pro stays active until the end of the period you've paid for.
- Refunds. Refunds are handled by Apple or Google under their refund policies. We can't issue refunds for store purchases directly. This does not affect any rights you have under consumer law.
- Restoring. If you reinstall the app or change devices, use "Restore purchases" in the app with the same store account.
- Price changes. We may change Pro prices. Apple or Google will tell you in advance and, where required, ask for your consent before a higher price applies.
6. Shop orders
- Prices and payment. Shop prices are shown in South African rand (ZAR) and include VAT where applicable. Payment is processed by PayFast or Yoco under their own terms. An order is accepted when you receive an order confirmation.
- Delivery. We currently deliver within South Africa only. Delivery times shown are estimates. Please make sure your delivery address is correct; we can't be responsible for delays or losses caused by an incorrect address.
- Availability. Products depend on stock. If we can't fulfil an order, we will tell you and refund you in full.
- Returns. You may return unused items in their original packaging within 7 days of delivery, and defective items within 6 months of delivery, in line with the Consumer Protection Act, 2008. Personalised items can only be returned if they are defective. Email us with your order reference to arrange a return.
- Your rights. Nothing in these Terms limits your rights under the Consumer Protection Act, the Electronic Communications and Transactions Act, 2002 or other consumer law that can't be excluded.
7. Your content
Journal entries, photos and other content you add ("Your Content") belong to you. Your Content is stored on your device, so you are responsible for keeping it backed up. We don't claim any ownership of it and we don't receive a copy unless you choose to send it to us.
When you share a keepsake card or other content from the app, you are responsible for what you share and who you share it with.
8. Acceptable use
When using the Service, you agree not to:
- break any law or anyone else's rights;
- interfere with, overload or try to gain unauthorised access to the Service or our systems;
- use bots, scrapers or other automated tools to copy content from the Service;
- place fraudulent orders or use payment details you aren't authorised to use;
- tamper with, click or block ads in a way that manipulates ad metrics.
9. Our content and trademarks
The Service, including its dictionary definitions, weekly content, quizzes, illustrations, design, software and the Pregtionary name and logo, is owned by us or our licensors and is protected by copyright, trademark and other laws. Apart from the licence in section 4, these Terms don't give you any rights to it.
If you send us feedback or suggestions, we may use them freely without paying you or crediting you.
10. Ads and third-party services
The free version of Pregtionary shows ads from Google AdMob. We don't endorse advertised products, and anything you buy from an advertiser is between you and them. Some features rely on third-party services such as Apple, Google, RevenueCat, PayFast and Yoco, whose own terms also apply.
11. Changes and availability
We work to keep Pregtionary accurate and available, but we may update, change or remove content and features, and the Service may sometimes be unavailable for maintenance or reasons outside our control. If we stop offering Pregtionary Pro, we will give you reasonable notice and stop renewals.
12. Disclaimers
To the extent allowed by law, the Service is provided "as is" and "as available". We don't promise that it will be error-free or uninterrupted, or that its content is complete, current or suitable for your personal situation. Some laws don't allow these exclusions, so they may not all apply to you.
13. Limitation of liability
To the extent allowed by law:
- we are not liable for any loss or harm resulting from relying on information in the Service instead of getting professional medical advice;
- we are not liable for indirect, incidental, special or consequential losses, or for loss of data stored on your device;
- our total liability to you for any claim about the Service is limited to the greater of the amount you paid us in the 12 months before the claim and R500.
Nothing in these Terms limits liability for death or personal injury caused by our negligence, for fraud, for gross negligence or wilful misconduct, or any other liability that the law does not allow us to limit.
14. Indemnity
To the extent allowed by law, you agree to compensate us for reasonable losses and costs caused by your breach of these Terms or misuse of the Service. This does not apply to consumers where the Consumer Protection Act prohibits it.
15. Ending these terms
You can stop using the Service at any time by deleting the app, asking us to delete your account if you have one (see Deleting your data), and cancelling any subscription in your store settings. We may suspend or end your access if you seriously or repeatedly breach these Terms. Sections 2, 7, 9 and 12 to 18 continue to apply after these Terms end.
16. Governing law and disputes
These Terms are governed by the laws of the Republic of South Africa. If you have a complaint, please contact us first so we can try to resolve it. Otherwise, the South African courts have jurisdiction, but if you are a consumer living elsewhere you keep the protection of the mandatory laws of your country and may bring a claim in your local courts.
17. App store terms
If you downloaded Pregtionary from the Apple App Store
- These Terms are between you and us only, not Apple. We, not Apple, are solely responsible for the app and its content.
- Your licence is limited to using the app on Apple-branded products that you own or control, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the app. To the maximum extent allowed by law, Apple has no other warranty obligation for the app.
- We, not Apple, are responsible for handling any claims relating to the app or your use of it, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and claims under consumer-protection, privacy or similar laws.
- If anyone claims that the app or your use of it infringes their intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and discharging that claim.
- You confirm that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.
- You must also comply with any third-party terms that apply when using the app.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
If you downloaded Pregtionary from Google Play
Your use of Google Play is also subject to the Google Play Terms of Service. Google is not responsible for the app or these Terms.
18. General
- Changes to these Terms. We may update these Terms. We will change the "Last updated" date and, for significant changes, tell you in the app before they take effect. If you keep using the Service after that, the new Terms apply.
- Whole agreement. These Terms and the Privacy Policy are the whole agreement between you and us about the Service.
- Severability. If any part of these Terms is found unenforceable, the rest still applies.
- No waiver. If we don't enforce a right straight away, we can still enforce it later.
- Transfer. We may transfer these Terms to a successor business. You may not transfer them without our written consent.
